Privacy Policy for PinHi

This Privacy Policy describes how Niftly LLC ("we," "us," or "our") collects, uses, and shares information when you use PinHi, including during our closed beta testing through Apple TestFlight.

By using PinHi, you agree to the collection and use of information in accordance with this policy. If you do not agree, do not use PinHi.


1. Who We Are

2. Beta Testing Notice

PinHi is currently distributed as a closed beta through Apple TestFlight. As a beta tester:

  • PinHi may contain bugs, incomplete features, and unstable behavior.
  • Data you create in PinHi (rounds, scores, social connections, etc.) may be deleted, reset, or migrated as we develop the product. We do not guarantee data persistence during the beta period.
  • We may collect additional diagnostic information to identify and fix issues.
  • If you have signed a separate Non-Disclosure Agreement (NDA) with us as a tester, the confidentiality obligations in that NDA apply alongside this Privacy Policy.

3. Information We Collect

3.1 Information You Provide

  • Account information: name, email address, and password (passwords are stored hashed; we never see your plaintext password).
  • Golf profile information: handicap index, home course, and any other profile details you choose to provide.
  • Round and shot data: scores, hole-by-hole results, shot locations, club selections, and any notes or annotations you create.
  • Social information: the Clubs, and other groups you join or create; the other users you connect with; messages, comments, or content you post within social features.
  • User-generated media: photos or other media you upload to PinHi (for example, profile pictures or round photos).
  • Communications: feedback, bug reports, support requests, and any other correspondence you send us.

3.2 Information Collected Automatically

  • Location data: precise GPS location during active rounds, used for course tracking, distance measurement, and shot location features. Location collection only occurs while you are actively using these features and can be disabled in your device settings.
  • Device and usage information: device model, operating system version, app version, language, time zone, IP address, and information about how you interact with PinHi.
  • Diagnostic and performance data: crash logs, error reports, performance metrics, and similar telemetry used to monitor App stability and improve performance.

3.3 Information from Third Parties

  • Apple TestFlight: Apple provides us with aggregate beta testing metrics, crash reports, and any feedback you submit through TestFlight.

3.4 Payment Information (Planned)

PinHi does not currently process payments. If we add paid features in the future, payments will be processed through Apple's App Store, and we will not receive or store your full payment card details. We will update this policy before any payment processing begins.


4. How We Use Your Information

We use the information described above to:

  • Provide and operate PinHi's features (course tracking, scoring, handicap integration, social groups, AI commentary, coaching analytics, etc.).
  • Authenticate you and secure your account.
  • Generate personalized content, including AI-generated commentary on your rounds (see Section 5).
  • Communicate with you about your account, beta updates, support requests, and material changes to our services.
  • Monitor, debug, and improve PinHi.
  • Detect, investigate, and prevent fraud, abuse, and security incidents.
  • Comply with legal obligations and enforce our terms.

We do not sell your personal information, and we do not use your information for third-party advertising.


5. AI-Generated Commentary

PinHi includes an AI-powered commentator feature that generates narrative content about your rounds. To produce this content, we send relevant round context (such as scores, shot data, and course information) to Anthropic, PBC, which operates the underlying language model.

  • Round context sent to Anthropic may include data you provided (scores, shot locations, etc.) and metadata about the round.
  • We do not send your password, email, GHIN number, or precise account identifiers to Anthropic.
  • Anthropic processes this data as our service provider under their terms. See Anthropic's privacy practices at https://www.anthropic.com/legal/privacy.

You can opt out of AI commentary in your App settings; if you opt out, no round data will be sent to Anthropic.


6. How We Share Information

We share information only as described below. We do not sell personal information.

6.1 Service Providers

We share information with third-party service providers who help us operate PinHi. Each provider receives only the information needed to perform its function:

These providers are bound by contractual obligations to handle your data securely and only for the purposes we specify.

6.2 Other Users

Information you share within social features (Clubs, comments, profile information you choose to make visible) is visible to other users you connect with or to other members of groups you join. Do not post information in social features that you would not want other users to see.

6.3 Legal and Safety

We may disclose information if we believe in good faith it is necessary to: comply with a law, regulation, subpoena, or legal process; protect the rights, property, or safety of Niftly LLC, our users, or others; investigate fraud or security issues; or enforce our terms.

6.4 Business Transfers

If Niftly LLC is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such transfer that materially changes how your information is handled.


7. Data Retention

We retain your information for as long as your account is active or as needed to provide PinHi. After account deletion, we typically delete or anonymize your personal information within 30 days, except where we are required to retain it longer for legal, tax, security, or fraud-prevention purposes. Aggregated or de-identified data that cannot reasonably be linked to you may be retained indefinitely.

During the beta period, we may also delete data as described in Section 2.


8. Your Rights and Choices

8.1 Account Controls

You can review and update most of your profile information directly in PinHi. You can request deletion of your account by contacting us at the email in Section 1.

8.2 Location Permissions

You can enable or disable location access for PinHi at any time through your device's system settings. Disabling location will limit features that depend on it (course tracking, GPS distances, shot location).

8.3 Push Notifications

You can disable push notifications in your device settings.

8.4 Regional Rights

California residents (CCPA/CPRA): You have the right to know what personal information we collect, to request deletion or correction, to opt out of any sale or sharing of personal information (we do not sell or share for cross-context behavioral advertising), and to be free from retaliation for exercising these rights.

EEA, UK, and Swiss residents (GDPR/UK GDPR): You have rights of access, rectification, erasure, restriction of processing, data portability, and objection to processing. Where we rely on consent, you may withdraw it at any time. You may also lodge a complaint with your local data protection authority. Our legal bases for processing include performance of a contract (operating PinHi), legitimate interests (improving and securing PinHi), consent (for optional features such as AI commentary), and compliance with legal obligations.

9. International Data Transfers

We are based in the United States, and our service providers operate in the United States and other countries. If you access PinHi from outside the United States, your information will be transferred to, stored, and processed in the United States and potentially other jurisdictions whose data protection laws may differ from those of your country.


10. Children's Privacy

PinHi is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, contact us and we will take steps to delete it. PinHi is intended for users age 13 and older; users under 18 should have parental consent to use PinHi.


11. Security

We use reasonable administrative, technical, and physical safeguards to protect your information, including encryption in transit (TLS), hashed password storage, access controls, and infrastructure provided by reputable cloud providers. No method of transmission or storage is 100% secure, however, and we cannot guarantee absolute security. If we become aware of a security incident that affects your information, we will notify you as required by applicable law.


12. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you through PinHi, by email, or by other reasonable means before the changes take effect. The "Last updated" date at the top of this policy indicates when it was last revised. Your continued use of PinHi after the effective date of the updated policy constitutes acceptance of the changes.
